If you sell consumer products to EU customers and your business is outside the European Union, you need an EU Responsible Person. Here's who this applies to.
If your company is registered in China, the United States, Turkey, India, the United Kingdom (post-Brexit), or any other non-EU country, you are required to appoint an EU-based Responsible Person before selling consumer products in Europe. This applies regardless of your company size — from solo entrepreneurs to large factories. The EU does not make exceptions based on business volume or product type.
If you sell on any European marketplace — Amazon.de, Amazon.fr, Amazon.it, Amazon.es, eBay EU, Temu, Etsy, or through your own Shopify store with EU customers — you need GPSR compliance. The General Product Safety Regulation (EU) 2023/988 is officially adopted by the European Parliament and Council. This replaces the old General Product Safety Directive from 2001 and introduces the mandatory EU Responsible Person requirement for non-EU sellers.
13 December 2024
GPSR becomes mandatory across all 27 EU member states. From this date, every non-EU economic operator must have a designated EU Responsible Person before placing consumer products on the European market. The transition period is over.
2025
Amazon, eBay, and other EU marketplaces begin active enforcement. Listings without valid EU Responsible Person data are suspended or removed. Thousands of non-EU sellers lose their European sales overnight. This is happening right now.
2026
EU customs authorities across all member states actively flag and intercept non-compliant shipments at borders. Products without proper GPSR documentation are seized. Enforcement is now fully operational at both marketplace and border levels.
GPSR applies across all 27 EU member states, but enforcement intensity varies. Here's what you need to know about the key markets.
Germany has the strictest enforcement in the EU. The German Federal Network Agency (Bundesnetzagentur) and market surveillance authorities actively monitor Amazon.de listings. Germany is the largest e-commerce market in Europe — if you sell in the EU, your German listings are likely your biggest revenue source. Non-compliance here means losing your most valuable EU market first.
France's consumer protection authority (DGCCRF) conducts regular product safety inspections both online and at borders. French customs are particularly active at major ports like Le Havre and Marseille, where many Asian shipments enter the EU.
Both Italy and Spain have growing e-commerce markets and are increasing GPSR enforcement. Amazon.it and Amazon.es apply the same compliance requirements as Amazon.de.
